Privacy Policy and User Agreement

Last Updated: September 15, 2026

Please read this document carefully before using the inOrder planning tool. It contains two parts: Part One – User Agreement, which governs your use of this service, and Part Two – Privacy Policy, which explains how your information is collected and used. By checking the box confirming you have read this document, you agree to both parts in full.

Part One: User Agreement

1. Acceptance of Terms

This User Agreement ("Agreement") is entered into between you ("you" or "User") and Plan inOrder ("Company," "we," "us," or "our"), the company that develops and operates inOrder, the online planning tool through which this document is presented ("inOrder," "the Tool," or "the Service"). By checking the acknowledgment box and proceeding, you confirm that you have read, understood, and agree to be bound by this Agreement. If you do not agree, do not proceed with the Tool.

2. Description of the Service

inOrder is a software platform, provided by Plan inOrder, that funeral homes, cemeteries, and other service providers ("Provider," "Funeral Home," or "Tenant") use to offer an online planning tool to their clients and families. This tool allows you to record preferences, selections, and information relevant to funeral, burial, cremation, or memorial arrangements, and to review pricing information made available by the Provider.

Plan inOrder is a technology company, and inOrder is a technology platform only. Neither Plan inOrder nor inOrder is a funeral home, cemetery, cremation provider, or licensed funeral director, and neither provides funeral, burial, cremation, or related professional services. The Provider through which you are accessing the Tool is solely responsible for the services it offers, the accuracy of the content and pricing it publishes, and the fulfillment of any arrangements you make.

3. Not a Contract for Services; No Binding Arrangement Created

Completing the inOrder planning tool, selecting options, or reviewing price lists does not create a contract, reservation, or binding arrangement between you and the Provider, and does not create any contract between you and Plan inOrder. Information you submit is a statement of preferences intended to assist you and the Provider in a future conversation. Any actual funeral, burial, cremation, merchandise, or service arrangement — and any legally binding agreement or payment obligation — must be separately executed directly with the Provider, in the form and manner the Provider requires (which may include a signed statement of funeral goods and services or equivalent contract required by law).

4. Pricing Information

Any General Price List, Casket Price List, Outer Burial Container (Vault) Price List, or other pricing information displayed alongside the Tool is supplied by the Provider, not by Plan inOrder. Plan inOrder does not set, verify, guarantee, or warrant the accuracy, completeness, or current validity of any price, and prices are subject to change by the Provider without notice to Plan inOrder. Final pricing, availability, and any applicable taxes or fees will be confirmed directly by the Provider at the time you enter into an actual agreement for goods or services.

5. Your Responsibilities

You agree to:

6. No Legal, Financial, or Medical Advice

Nothing in the Tool, including any informational content, prompts, or suggested options, constitutes legal, financial, tax, religious, or medical advice from Plan inOrder. You should consult appropriate licensed professionals or the Provider directly for guidance specific to your situation.

7. Intellectual Property

The inOrder Tool, including its software, design, text prompts, workflows, and underlying technology, is the property of Plan inOrder or its licensors and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Tool for its intended personal purpose. You may not copy, reverse-engineer, resell, or redistribute the Tool or its underlying technology.

8. Third-Party Content and Services

The Tool may display content, branding, or information provided by the Provider, or links to third-party sites. Plan inOrder is not responsible for the accuracy or availability of third-party content and does not endorse it.

9. Disclaimer of Warranties

THE INORDER TOOL IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. PLAN INORDER DOES NOT WARRANT THAT THE TOOL WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY PRICING OR CONTENT DISPLAYED IS CURRENT OR ACCURATE.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PLAN INORDER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, ARISING FROM YOUR USE OF THE INORDER TOOL, INCLUDING ANY RELIANCE ON PRICING OR CONTENT SUPPLIED BY A PROVIDER. PLAN INORDER’S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE TOOL SHALL NOT EXCEED THE AMOUNT, IF ANY, YOU PAID DIRECTLY TO PLAN INORDER FOR USE OF THE TOOL. THIS SECTION DOES NOT LIMIT ANY LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW AND DOES NOT AFFECT ANY SEPARATE AGREEMENT YOU ENTER INTO DIRECTLY WITH THE PROVIDER.

11. Indemnification

You agree to indemnify and hold harmless Plan inOrder from any claims, damages, or expenses arising from your misuse of the Tool or your violation of this Agreement.

12. Termination

The Provider or Plan inOrder may suspend or terminate your access to the Tool at any time, including for suspected misuse. Termination does not affect any arrangement already made directly with the Provider.

13. Governing Law and Dispute Resolution

This Agreement is governed by the laws of the State of Illinois, without regard to conflict-of-law principles. Any dispute arising from this Agreement shall be resolved in the state or federal courts located in Cook County, Illinois, and you consent to the jurisdiction of those courts.

14. Changes to This Agreement

Plan inOrder may update this Agreement from time to time. Material changes will be reflected in an updated "Last Updated" date. Continued use of the Tool after changes take effect constitutes acceptance of the revised Agreement.

15. Contact

Questions about this Agreement may be directed to Plan inOrder at support@planinorder.com or to the Provider directly.
